Terms of Service

1. Acceptance of Terms
By accessing or using Swanky Tools™ Booking (the “Service”), operated by Swanky Tools™, you agree to be legally bound by these Terms of Service (“Terms”) and our Privacy Policy and Disclaimer. If you do not agree to all of these Terms, do not access or use the Service.
These Terms apply to all users of the Service, including coaches, freelancers, consultants, and their clients, regardless of your location or jurisdiction.
2. Description of Service
Swanky Tools™ Booking is an all-in-one booking, website, and marketing platform that enables coaches, freelancers, consultants, tutors, therapists, and other service professionals (“Coaches”) to:
- Create a branded public booking page and professional website
- Offer services and accept online bookings with automated scheduling
- Accept payments via Stripe, Razorpay, or manual bank transfer
- Sell digital products and downloadable content
- Create and sell session packages and bundles
- Send email broadcasts to leads and clients
- Capture leads from their booking page
- Issue discount coupons and offer group sessions or webinars
Swanky Tools™ provides the technology platform only. We are not a coaching service provider, and we do not endorse, certify, or guarantee the quality, credentials, or conduct of any Coach using the Service.
3. Eligibility & Accounts
You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction to use the Service. By registering, you represent that this is the case.
You must provide accurate, current, and complete information when creating your account, and keep it updated. You are solely responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use at support@predintel.zohodesk.in
You may not create more than one account per person, or create accounts on behalf of others without their explicit consent.
4. Coach Responsibilities
Coaches using the Service represent, warrant, and agree that they will:
- Provide accurate and truthful descriptions of their services, qualifications, pricing, and availability
- Deliver all services and digital products as described and paid for by clients
- Comply with all applicable laws and regulations in their jurisdiction, including consumer protection, tax, data protection, and professional licensing laws
- Handle client cancellations, refunds, and disputes fairly and in accordance with their stated policies
- Not make misleading income claims, health claims, or other representations that violate advertising standards
- Obtain all necessary consents before uploading client contact lists for email marketing
- Ensure all digital products they sell do not infringe third-party intellectual property rights
Swanky Tools™ is not responsible for any representations made by Coaches to their clients, and is not a party to any agreement between a Coach and their clients.
5. Payments & Billing
5.1 Client Payments to Coaches
Payments for bookings, digital products, and packages are processed by Stripe and/or Razorpay. Funds from client payments are deposited directly into the Coach’s connected payment account. Swanky Tools™ does not hold, process, or have access to client funds at any point.
Coaches are responsible for setting up their own Stripe or Razorpay accounts, complying with their respective terms of service, and any applicable KYC/AML requirements. Payment processing fees charged by Stripe or Razorpay are the Coach’s responsibility and are separate from platform subscription fees.
5.2 Platform Subscription Fees
Access to Pro and Business plan features requires payment of a platform subscription fee. Subscription fees are pre-paid for the stated plan duration (typically 30 days) and are charged at the time of purchase. We do not auto-bill. There are no recurring charges without your action.
All prices are displayed in INR and USD. Applicable taxes may apply depending on your jurisdiction.
5.3 No Platform Fees (First Year)
During your first year on the platform, Swanky Tools™ does not charge any commission or platform fee on bookings or product sales. After the first year, platform fee terms may be updated with 30 days’ prior notice.
6. Refund Policy
6.1 Coach–Client Refunds
Refunds for bookings, sessions, packages, and digital products are the sole responsibility of the Coach. Coaches must communicate their refund and cancellation policies clearly to clients before purchase. Swanky Tools™ is not responsible for and cannot process refunds for transactions between Coaches and their clients.

6.2 Platform Subscription Refunds
Requests for refund of platform subscription fees are reviewed on a case-by-case basis. Refund requests must be submitted within 48 hours of purchase by contacting support@predintel.zohodesk.in with your account email and order details. We reserve the right to decline refunds where the Service has been accessed and used.
7. Email Marketing
The Service includes tools to send broadcast emails to leads and clients. By using these features, you agree to:
- Only send emails to contacts who have given you lawful consent or with whom you have a legitimate business relationship
- Include your business name and a valid postal address in every email
- Include a functioning one-click unsubscribe link (provided automatically by the platform)
- Honour unsubscribe requests immediately — the platform processes these automatically
- Not use the email tools to send spam, phishing, or unsolicited bulk communications
- Comply with all applicable anti-spam laws including CAN-SPAM (USA), CASL (Canada), and GDPR (EU/UK)
Swanky Tools™ reserves the right to suspend email sending privileges for any account found to be in violation of these requirements or that generates excessive bounce or spam complaint rates.
8. Digital Products
Coaches may upload and sell digital products (PDFs, eBooks, templates, videos, etc.) through the platform. You represent that:
- You own or have all necessary rights and licences to the content you upload
- Your content does not infringe any third-party intellectual property rights
- Your content does not contain malware, illegal content, or material that violates these Terms
You retain full ownership of your content. Swanky Tools™ does not claim any ownership or licence over content you upload, except as necessary to provide the Service (e.g., storing and delivering the file to buyers).
9. Prohibited Uses
You may not use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Upload, post, or transmit fraudulent, deceptive, or misleading content
- Send spam, unsolicited bulk email, or messages to contacts without consent
- Infringe the intellectual property rights of others
- Impersonate any person or entity
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Use automated tools to scrape, crawl, or extract data from the Service
- Interfere with or disrupt the integrity or performance of the Service
- List or promote services that are illegal, harmful, or exploitative
- Resell or sublicense the Service without our written permission
10. Intellectual Property
The Service, including its software, design, text, graphics, and branding, is owned by Swanky Tools™ and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
The “Swanky Tools™” name and logo are trademarks of Swanky Tools™. Unauthorised use is prohibited.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the Service will be error-free or that defects will be corrected.

12. Limitation of Liability
To the maximum extent permitted by applicable law, Swanky Tools™, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of revenue, loss of data, loss of clients, or business interruption.
Our total aggregate liability to you for any claims arising under or relating to these Terms shall not exceed the greater of: (a) the amount you paid us in the 3 months preceding the claim, or (b) USD $50.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Swanky Tools™ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your content uploaded to or transmitted via the Service; or (d) any claim by a client arising from your services or products.
14. Termination
You may delete your account at any time by contacting us at support@predintel.zohodesk.in. Upon deletion, your public booking page and website will be taken offline immediately.
We reserve the right to suspend or permanently terminate your account, with or without notice, if you: violate these Terms; engage in fraudulent activity; abuse the Service; or pose a risk to other users. In cases of material violation, we may terminate immediately without refund.
Upon termination, your personal data will be retained for 30 days before deletion, subject to legal retention obligations.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of India (specifically the laws of the State of Karnataka), without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings held in Bangalore, Karnataka, India.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
17. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, Disclaimer, and Cancellations Policy, constitute the entire agreement between you and Swanky Tools™ regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
- Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it later.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign ours freely.
- Force Majeure: We are not liable for any failure or delay due to causes beyond our reasonable control.
